1. Acceptance of Terms
By accessing or using DocTik ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. DocTik, Inc. ("we," "us," or "our") reserves the right to update these Terms at any time. Continued use after changes constitutes acceptance.
2. Description of Service
DocTik is a web-based legal case management platform designed to assist pro-se litigants (individuals representing themselves in civil legal proceedings) in organizing case materials, tracking deadlines, managing documents, and accessing AI-assisted legal research and document drafting tools.
DocTik is a legal information tool, not a law firm, and does not provide legal advice. Nothing on the platform constitutes attorney-client communication or legal representation.
3. No Attorney-Client Relationship
IMPORTANT: Use of DocTik does not create an attorney-client relationship between you and DocTik, Inc. or any of its employees, contractors, or AI systems. The AI features within DocTik provide informational assistance only. All content generated by DocTik AI should be reviewed by a licensed attorney before reliance, especially for court filings.
We strongly encourage users to consult with a licensed attorney for legal advice specific to their situation. DocTik is not a substitute for professional legal counsel.
4. Eligibility
You must be at least 18 years of age to use the Service. By using DocTik, you represent that you are 18 or older and have the legal capacity to enter into these Terms.
5. Account Registration
To access most features, you must create an account. You agree to:
- Provide accurate, complete, and current information
- Maintain the security of your password
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
6. Subscription and Credits
DocTik offers free and paid subscription plans. Paid plans are billed monthly or annually as selected at purchase. All fees are non-refundable except as required by law.
AI credits are consumed per interaction as described in our pricing page. Unused credits do not roll over between billing periods on the Free plan. Credits on paid plans may roll over as specified in your plan details.
We reserve the right to change pricing with 30 days' notice to existing subscribers.
7. Acceptable Use
You agree not to use DocTik to:
- Violate any applicable law or regulation
- Submit false, misleading, or fraudulent information to courts or opposing parties
- Harass, intimidate, or harm any person
- Attempt to reverse-engineer, scrape, or extract data from the platform
- Use AI features to generate content that is defamatory, fraudulent, or intended to deceive courts
- Share account credentials or allow unauthorized users to access your account
- Use the Service for criminal proceedings (DocTik is designed for civil matters only)
8. User Content and Data
You retain ownership of all documents, case data, and content you upload to DocTik ("User Content"). By uploading User Content, you grant DocTik, Inc. a limited license to process and store it solely to provide the Service.
You are responsible for ensuring you have the right to upload any documents (e.g., that you are not uploading confidential third-party materials in violation of court orders or confidentiality agreements).
We will not sell, license, or share your User Content with third parties except as described in our Privacy Policy or as required by law.
9. AI-Generated Content
DocTik uses third-party AI models (including Anthropic's Claude) to generate legal research, document drafts, and analysis. You acknowledge that:
- AI-generated content may be inaccurate, incomplete, or outdated
- Legal citations generated by AI should be independently verified
- DocTik AI does not provide legal advice and should not be solely relied upon for legal strategy
- You are solely responsible for any legal documents you file in court
10. Intellectual Property
The DocTik platform, including its design, code, logos, and non-user content, is owned by DocTik, Inc. and protected by intellectual property law. You may not copy, modify, or distribute any part of the platform without our express written consent.
AI-generated drafts and research produced in response to your inputs belong to you, subject to the limitations of applicable AI service providers' terms.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DOCTIK, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR LEGAL OUTCOMES, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.
This limitation applies even if we have been advised of the possibility of such damages. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless DocTik, Inc., its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorney fees) arising from your use of the Service, your User Content, or your violation of these Terms.
14. Privacy
Your use of DocTik is governed by our Privacy Policy, which is incorporated into these Terms by reference.
15. Termination
You may cancel your account at any time from your account settings. We may terminate or suspend your access immediately, without notice, if you breach these Terms or if required by law.
Upon termination, your right to access the Service ceases. We may retain certain data as required by law or as described in our Privacy Policy. You may request export of your data before cancellation.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles. Any disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property or data security matters.
You waive any right to participate in a class action lawsuit or class-wide arbitration against DocTik, Inc..
17. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
